These Terms of Use (“Terms”) govern your use of demandwiseenergy.com (the “Site”), operated by DemandWise Energy LLC (“DemandWise,” “we,” “us,” or “our”). By using the Site or submitting an inquiry, you agree to these Terms. If you do not agree, please do not use the Site.
The Site provides general information about DemandWise and our demand-management product and services, and lets you contact us to ask whether our product is a fit for your home. The Site is informational only. Nothing on the Site is an offer to sell, a binding quote, or a contract. Any purchase, installation, or financing is handled separately and is governed by the specific agreements you sign at that time, not by these Terms.
You must be at least 18 years old and able to enter into a contract to use the Site or submit an inquiry. Our product is intended for homeowners in Arizona served by participating utilities, including APS and SRP demand-rate plans. By contacting us, you confirm the information you provide is accurate and that you are authorized to share it, including any utility bill you choose to send.
When you ask us to review your bill or rate plan, we provide an informational assessment of whether our product may benefit your home. Any review, estimate, or figure we provide is an estimate based on the information available to us at the time. It is not a guarantee, a binding quote, or a promise of any particular result.
Any savings figures, examples, percentages, or projections shown on the Site or shared with you are general illustrations of how demand-rate billing works. They are not a guarantee of savings. Actual results depend on factors specific to you, including your utility, rate plan, home, equipment, and how and when you use electricity, as well as future utility rates, which we do not control and which can change. DemandWise is not a utility and does not set utility rates.
If you decide to purchase our product, the sale, installation, warranty, pricing, and any cancellation rights will be set out in a separate written agreement between you and DemandWise (and, where applicable, the manufacturer or installer). If you choose to finance your purchase, financing is provided by a third-party financing partner under that partner’s own application, terms, and approval process. DemandWise is not a lender and does not make credit decisions.
The Site or our communications may link to or reference third parties, such as a financing partner. We do not control those third parties and are not responsible for their content, products, services, or privacy practices. Your dealings with any third party are solely between you and that third party.
The Site and its content — including text, graphics, logos, and the DemandWise name and branding — are owned by or licensed to DemandWise and are protected by applicable laws. You may view and use the Site for your personal, non-commercial purposes. You may not copy, reproduce, distribute, or create derivative works from the Site or its content without our prior written permission.
You agree not to misuse the Site. This includes not attempting to disrupt or gain unauthorized access to the Site, not submitting false or misleading information, not uploading malicious code, and not using the Site for any unlawful purpose or in violation of these Terms.
The Site and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that information on the Site is complete, current, or accurate at all times.
To the fullest extent permitted by law, DemandWise and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages. Nothing in these Terms limits any rights you may have that cannot be limited or excluded under applicable law.
You agree to indemnify and hold harmless DemandWise from any claims, losses, or expenses arising out of your misuse of the Site or your violation of these Terms.
DemandWise Energy LLC is an independent company and is not affiliated with, endorsed by, or sponsored by APS or SRP. Utility names and trademarks are the property of their respective owners and are used only to describe the rate plans our product is designed to work with.
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. You agree that any dispute relating to the Site or these Terms will be handled in the state or federal courts located in Arizona.
We may update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of the Site after we post changes means you accept the updated Terms.
